Common questions

Frequently asked questions

Honest answers about expungement, pricing, and what we do.

Eligibility

Am I eligible to have my record expunged?
Eligibility depends on your state’s law, the type of conviction, time elapsed since completion of all sentences, and whether you have new charges or arrests. Our free eligibility review tells you whether your case may qualify under your state’s statutes. Use our eligibility check to find out in minutes.
Can felonies be expunged?
Many states allow expungement or sealing of certain felony convictions, especially non-violent offenses, after a waiting period. Some states exclude violent felonies, sex offenses, and DUIs. We confirm what your state allows during the eligibility review.
What about juvenile records?
Most states have separate, often more permissive processes for juvenile records — sometimes with automatic sealing at adulthood. Our service handles juvenile record clearing in addition to adult cases.
Can I expunge a record from another state?
Expungement is governed by the state where the conviction occurred, not where you currently live. We coordinate filings in all 50 states regardless of your current residence.

Pricing

What does it cost?
Our service fee is a flat $10,000 per record. Financing is available at $2,500 per month for 5 months ($12,500 total financed). Additional records on the same case are $5,000 each. Court filing fees are separate, vary by county and state, and are billed at cost. There are no hourly charges.
Is there a refund if my petition is denied?
We do not offer a money-back guarantee. We do offer a “we work until it’s done” commitment: as long as your case qualifies under your state’s statutes, we continue working — including refiling at no additional service fee if a petition is denied for procedural reasons.
Do you offer discounts?
Veterans receive 10% off the service fee with valid proof of service. We also have a referral partner program that pays 5% commission on every successful client introduction.

Process

How long does the process take?
Document preparation typically takes 2–4 weeks. Court processing varies widely by jurisdiction — from 60 days to 6 months in most states. The total timeline from engagement to final order is usually 3–7 months.
Will my record show up on background checks after expungement?
Most expungement orders remove records from public background check databases. Some categories of employer — federal positions, healthcare, education, law enforcement — may retain access to expunged records under specific statutory exceptions. We explain what your state’s expungement covers during the eligibility review.
Are you a law firm?
No. Fresh Start Expungement is a record-clearing services provider, not a law firm. We coordinate document preparation and filing for individuals seeking expungement. We do not provide legal advice or attorney representation. Complex or contested matters may require independent legal counsel.
What happens at the hearing?
Many expungement petitions are decided on paper without a hearing. When a hearing is required, the petitioner typically appears before the judge. We prepare the documentation and brief you on what to expect. If your case requires legal representation at a hearing, we recommend engaging independent legal counsel.
